San Antonio Woman received 29 years for Fraud

The United States Acting Attorney for the Western District of Texas, John E. Murphy announced in a press lease on September 11 that Rosario Divins has been charged with twenty nine year and one month in federal prison for defrauding individuals by representing herself as a foreclose prevention specialist.

Divins was found in criminal contempt for continuing her scheme after the United States Bankruptcy court for the Western District of Texas ordered her to ease and assist with regard to her mailings falsely representing herself as a foreclosure prevention specialist. Divins did not stop and continue to make fraudulent promises to her clients. The Bankruptcy court cited her three times for violation on three separate occasions.

Divins trial that lasted three days revealed that Divins since 2000 had been running the fraudulent scheme to defraud at risk homeowners. She sent out mailings representing herself as a foreclosure prevention specialist and those homeowners that responded to her mailing were taken advantage of. Divins collected over eighty thousand dollars in cash from individuals seeking relief from foreclosure.

Divins was convicted on June 17, 2009 and was remanded to jail pending her sentencing. She was convicted on seven counts of criminal contempt and mail fraud.

United States District Judge Murphy also ordered Divins to restitution in the amount of eighty three thousand six hundred dollars to the victims of her scam. Divins sentenced included that upon her release she has supervised provision for three years. Divins will be eighty four years of age when she is released if she is not released prior to her twenty nine year sentence.

The case was investigated by the Federal Bureau of Investigation. The case will be prosecuted by Assistant United States Attorney Mark Lane.
